1. About these terms
These Terms of Service ("Terms") govern your access to and use of Peekaboo, a newborn visit coordination application provided by De Wet Holdings Pty Ltd as Trustee for Happy Trust ("we", "us", "Happy Trust"), operating at peekaboo.byhappytrust.com.
By accessing or using Peekaboo, you agree to be bound by these Terms. If you do not agree, please do not use the service.
These Terms are governed by the laws of Queensland, Australia.
2. The service
Peekaboo is a web-based application that allows new parents ("Parents") to create a personalised visit schedule page and share it with family and friends ("Visitors"). Parents can set visiting rules, availability, and preferences. Visitors can browse available times and request or book visits.
Peekaboo is provided as a Progressive Web App (PWA) accessible via a web browser. No installation is required.
3. Eligibility and accounts
You must be at least 18 years old to use Peekaboo. By using the service, you confirm that you meet this requirement.
When you create a Peekaboo page, you are responsible for all activity that occurs under your family's unique URL. Please keep your access link private and share it only with people you trust.
4. Payment and access
Peekaboo is available for a one-time payment of AU$14.99 (or local currency equivalent), which grants the purchasing family permanent access to their Peekaboo page.
- Payments are processed securely by Stripe
- Prices are displayed in your local currency where possible, with AU$ as the base currency
- The one-time fee covers a single family's Peekaboo page
- No recurring charges or subscription fees apply
5. Your content
You own the content you add to Peekaboo โ your family's names, notes, rules, and scheduling preferences remain yours. By using the service, you grant Happy Trust a limited licence to store and display that content solely for the purpose of operating your Peekaboo page.
You agree not to add content that is unlawful, harmful, defamatory, or otherwise objectionable. We reserve the right to remove content or suspend access if we believe these Terms are being violated.
6. Acceptable use
You agree to use Peekaboo only for its intended purpose: coordinating newborn visits with family and friends. You must not:
- Use Peekaboo to harass, deceive, or harm any person
- Attempt to access another family's Peekaboo page without authorisation
- Reverse engineer, copy, or reproduce any part of the service
- Use automated tools (bots, scrapers) to access or interact with Peekaboo
- Attempt to disrupt or interfere with the service's operation
7. Availability and changes
We aim to keep Peekaboo available and working well, but we do not guarantee uninterrupted access. Peekaboo relies on third-party infrastructure (including Supabase and Netlify) and may occasionally be unavailable due to maintenance or outages beyond our control.
We may update, modify, or improve Peekaboo at any time. We will not remove core features without reasonable notice to paying customers.
8. Limitation of liability
To the maximum extent permitted by law, Happy Trust is not liable for any indirect, incidental, or consequential loss arising from your use of Peekaboo, including loss of data, missed visits, or scheduling errors.
Our total liability to you for any claim arising from the use of Peekaboo is limited to the amount you paid for the service (AU$14.99).
Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be excluded, including any consumer guarantees.
9. Termination
You may stop using Peekaboo at any time. If you wish to have your data deleted, please contact us at info@byhappytrust.com.
We reserve the right to suspend or terminate access to Peekaboo if we believe these Terms have been materially violated, with or without notice depending on the severity of the breach.
10. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms. By using Peekaboo, you agree to the Privacy Policy.
11. Changes to these terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If changes are material, we will make reasonable efforts to notify you. Continued use of Peekaboo after updated Terms are posted constitutes acceptance of those changes.
12. Governing law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Queensland, unless you are a consumer with rights under the Australian Consumer Law to bring a claim in your state or territory.
